Learned Amicus Curiae has argued that there is long and undue delay in lodging FIR which was not explained properly, there are material contradictions in the statements of witnesses the plea of accused appellant that he was falsely implicated on account of some payment dispute between Prem and complainant Dalchandra, is supported by the statements of DW1, and negates the prosecution version, prosecutrix X was not medically examined, and there was no evidence that she has sustained any injury; and that there is absolutely nothing to indicate that alleged rape on the prosecutrix X was committed on the ground that she-1is a member of Scheduled Caste nor that the appellant has taken any undue advantage of being a member of upper caste.
